6 questions

  1. The steps of a conveyancing transaction are more or less as follows:

    a) taking initial instructions/ producing a quote and opening the file. This is where we will send our initial documents and compliance / Money Laundering requirements to each new client.

    b) draft contract pack/ review contract pack. Typically, the seller’s conveyancer drafts the contract pack, and the buyer’s solicitors draft the Transfer Deed. The contract pack will consist of the contract, protocol documents completed by the seller, and title documents (if registered). The buyer’s conveyancer will review the same with a view to raising their enquiries.

    c) The buyer’s conveyancer, on review of the documents provided and on their review of property searches, will then raise their enquiries.

    d) if the purchase is not a cash purchase, the buyer’s conveyancer will report to the buyer on the terms of the Mortgage Offer

    e) Once the buyer’s conveyancer is satisfied with the answers to enquiries received by the seller’s conveyancer, they will send a report on title to the buyer. Around this stage, both sides will arrange for the approved contract and transfer to be signed in readiness for exchange.

    f) Contracts are exchanged, and at which point both parties are legally bound to complete

    g) The property will complete and money changes hands.

    h)  The buyer’s conveyancer will tend to register the property with the Land Registry and pay the SDLT payable. Usually, the seller’s role is concluded here, but the seller’s conveyancer may need to be on hand to assist with any Land Registry requisitions raised.

  2. The National average seems to be 12-16 weeks. We aim for completion to occur within 8-12 weeks from instructions (when our initial paperwork is returned). However, it can be longer, depending on the complexity of each individual case and the requirements of any chain.  Our aim is the same as yours to conclude all transactions as quickly and efficiently as possible.

  3. In essence, buying a freehold property means you own the land in which the property is situated, together with the airspace above and soil beneath. If there is more than one dwelling within the same building, this will be leasehold as the airspace cannot be divided up, and mutual rights and covenants are required to protect each dwelling. There will therefore be one person (natural or otherwise) who owns the ‘freehold’, and the other owners will own their individual property as leasehold, subject to a lease which has a term often of 125 years but can be as long as 999 years in some cases.

If you are purchasing a leasehold property, this is a more complex transaction for you as a purchaser, so understanding what you are buying and the ongoing fees associated with this is imperative, something we will, of course, talk you through.

  4. Most of the conveyancing transactions can be concluded remotely. For instance, we can complete online ID Verification, and many documents can be signed electronically.

  5. Yes. As the law currently stands, you will only ever be bound at the exchange of contracts. This does give you flexibility and peace of mind in knowing that if something is adversely revealed affecting the property, you do not need to proceed. It does, however, unfortunately mean many transactions do not proceed to completion.

  6. We will always write to you or call you when anything material happens regarding your transaction. We also provide our contact details on our letters and emails so you can reach out to us at any stage.
