We recently concluded a significant medical negligence case involving a 71-year-old woman whose long-term partner tragically passed away whilst receiving care at the James Paget Hospital (JPH) in August 2019.
The case arose from a failure to diagnose and treat tuberculosis (TB) in her partner, a man in his early seventies. He had been under the care of a consultant at JPH, where it was alleged that crucial tests, which could have confirmed TB, were not arranged. Furthermore, he was admitted to JPH as an emergency patient, but the diagnosis of TB came too late, and, sadly, he passed away.
The deceased’s partner pursued a dependency claim, highlighting not only the financial loss of her partner’s income but also the heartbreaking loss of her companion of 40 years. Whilst the James Paget Hospital partially defended the case, both parties agreed to mediation.
An independent mediator, Paul Balen, facilitated discussions alongside our expert legal team. With a strong case skilfully presented by Simon Bransby (Chartered Legal Executive and Associate at Hatch Brenner) and Rosanna Hellebronth (barrister at Crown Office Chambers), the claim was resolved through mediation. The outcome was a significant compensation award for our client, recognising both the financial and emotional impact of her loss.
