Our client underwent lens replacement surgery at Optical Express but was left with ongoing visual disturbances including halos, glare, and starbursts, particularly affecting his ability to drive at night. These symptoms also negatively impacted his employment and overall quality of life.
Although there were no allegations of surgical negligence, the core of the claim centered around inadequate informed consent. The client reported that he was not properly advised about the potential risks associated with the procedure. Matters were further complicated when the type of lens originally discussed was changed at the last minute again, without proper consent.
The Claimant was clear: had he been fully informed of the risks, he would not have gone ahead with the surgery.
Despite Optical Express denying any fault in their consent process, we successfully negotiated a five-figure settlement. This compensation has allowed our client to set aside funds for potential remedial surgery and has provided some redress for the loss of earnings he suffered as a result of his ongoing symptoms.
