10 November 2025No one likes to contemplate their relationship ending during those happy, honeymoon years and, whilst we don’t wish to put a dampener on the happiness of any lovebirds out there, the reality is that in 2023 the median length of marriage in opposite-sex couple divorces was 12.7 years (ONS: Divorces and dissolutions in England and Wales: 2023).
Savvy couples know that when they get married, they’re entering into a legal contract that ties them in financially to one another and creates equitable interests in each other’s assets. Increasingly, those same savvy people are seeing the benefits of entering into a nuptial agreement when they choose to marry.
This shouldn’t be seen as a cold, unromantic start to a marriage but a decision which harnesses the trust, love and respect a couple has for one another at the outset of their relationship. The reality is that if you haven’t considered the financial implications of a separation or divorce at the beginning of the relationship, if that relationship turns sour and trust is lost and respect diminished this invariably results in a bitter battle as to who is entitled to what.
Therefore, acknowledging the respective and possibly differing contributions of each other at the outset and keeping the terms of your agreement regularly under review has the potential to lead to a much simpler, respectful and good divorce if that relationship does come to an end.
Resolution Good Divorce Week commencing on 10 November is perfectly timed with the arrival to our family team of divorce and matrimonial finance solicitor and Resolution member, Emma Kellett. As members of Resolution, we follow their Code of Practice designed to help couples resolve their separation issues, whether in relation to children or finances, as constructively as possible, putting the needs of the family first.
